Bloomington, Ind. – Tuesday afternoon, the U.S. District Court for the Southern District of Indiana ruled in favor of Cook Medical Incorporated and dismissed a patent infringement lawsuit filed by Endotach LLC, a subsidiary of the patent assertion entity Acacia Research Corporation. The lawsuit stated the various Cook stent grafts sold under the Zenith® brand infringed on patents that were allegedly licensed exclusively to Endotach.
Costs of litigation and threats of infringement allegations can hinder innovation and deny patients’ access to important new products.
“We are committed to defending our products against unsupported claims of patent infringement,” said Cynthia Kretz, Cook’s vice president and general counsel. “From day one, we vigorously defended this case, remaining confident in our defenses and determined to uphold the law,” added Ms. Kretz.
